Conditions of Release
If you have just been released following incarceration, a Grand Rapids criminal defense law office has information on what you should now expect.
One of the conditions of your release will likely be your consent to searches. You may experience the following:
- Searches of your home; and
- Random body searches
While searches seem harmless, they are actually riskier than drug testing. Drug testing can only reveal whether you are using drugs, but a search can reveal a wider array of criminal activity.
A search of your house may uncover contraband such as pornography, drugs or guns. Plus, searches are disruptive to your family, and your neighbors are likely to notice as well. Your lawyer should try to make consent to searches not a condition of your release in court.
Another condition to your release may be psychiatric evaluation or treatment. This is to make sure that you will be not be considered a danger to the community. Psychiatric evaluation is limited to certain type of offenses, including but not limited to the following:
- Homicide;
- Kidnapping;
- Sex crimes;
- Arson; and
- Crimes against children
If you are charged with one of these offenses, then a psychiatric evaluation may need to take place before your release. Lawyers can rarely change this, only prepare you for the evaluation procedure.
If you had drug and alcohol problems, then dependency treatment may also be a court requirement.
